An automated order-receipt message confirms that the order was received. Unless the message expressly states otherwise, it does not necessarily constitute acceptance.

Order Rejection and Cancellation

• Inability to fulfil the order.

Prices and Taxes

Standard shipping is free.

Any additional optional charge will be imposed only where clearly disclosed and validly selected or accepted. Preselected paid extras will not be used where prohibited.

Payment

Delivery

Transfer of Risk

For consumer purchases, the risk of accidental loss or damage generally remains with BabybooFashion.shop until the goods are delivered to the consumer or a third party designated by the consumer, other than the carrier.

If the consumer independently commissions a carrier not offered by us, risk may transfer as provided by applicable law.

Retention of Title

Goods remain the property of BabybooFashion.shop until the purchase price has been paid in full, to the extent permitted by law.

Right of Withdrawal

Conformity and Statutory Warranty

We are responsible for delivering goods that conform to the contract.

Mandatory statutory rights regarding defective or non-conforming goods remain unaffected. Depending on the circumstances and legal requirements, available remedies may include repair, replacement, price reduction, contract termination or refund.

Any voluntary commercial warranty applies in addition to, and does not replace or restrict, statutory rights.

Mandatory rights relating to non-delivery, additional delivery periods, termination and refunds remain unaffected.

Governing Law

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections provided by the law of your country of habitual residence.

Jurisdiction

Mandatory consumer jurisdiction rules apply.

Where the customer is a merchant, a legal entity under public law or a special fund under public law, the competent court at the operator’s legally established place of business may have jurisdiction where legally permitted.

Severability

If any provision is invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced only to the extent and in the manner permitted by applicable law.

Changes

The Terms applicable to an order are those presented when the order is placed.

We may update these Terms for future use. Changes will not retroactively alter an existing contract unless legally permitted and validly agreed.
